दिल्ली के सीएम अरविंद केजरीवाल ने सोमवार को सुप्रीम कोर्ट से कहा कि उन्होंने यूट्यूब पर ध्रुव राठी द्वारा पोस्ट किए गए कथित मानहानि कारक वीडियो को रिट्वीट करके गलती की है केजरीवाल की ओर से पेश वरिष्ठ वकील अभिषेक ने कहा मैं इतना कह सकता हूं कि मैने रिट्वीट करके गलती की है।
न्यायमूर्ति संजीव और न्यायमूर्ति दीपांकर की पीठ ने दिल्ली हाई कोर्ट के उसे फैसले को चुनौती देने वाली केजरीवाल की याचिका पर नोटिस जारी करने से परहेज किया। जिसमें आपराधिक मानहानि मामले में आरोपी के रूप में उन्हें जारी किए गए समन को बरकरार रखा गया था। इसके बजाय, उन्होंने पूछताछ की कि क्या शिकायतकर्ता मुख्यमंत्री की माफी पर विचार करते हुए मामले को बंद करना चाहता है। पीठ ने ट्रायल कोर्ट को केजरीवाल से जुड़े मानहानि मामले से संबंधित कार्यवाही 11 मार्च तक स्थगित करने का भी निर्देश दिया।
5 फरवरी के अपने फैसले में, दिल्ली उच्च न्यायालय ने मानहानि के मुकदमे में केजरीवाल को जारी किए गए समन को रद्द करने से इनकार कर दिया, और कहा कि जब कोई सार्वजनिक व्यक्ति ट्वीट या रीट्वीट करता है तो उसका प्रभाव फुसफुसाहट से कहीं अधिक होता है।
