दिल्ली। उच्चतम न्यायालय ने उत्तर प्रदेश सरकार के 105 सरकारी प्राथमिक स्कूलों को अन्य स्कूलों के साथ जोड़ने के फैसले के खिलाफ आम आदमी पार्टी से राज्य सभा सांसद संजय सिंह की रिट याचिका पर विचार करने से सोमवार इनकार कर दिया। न्यायमूर्ति दीपांकर दत्ता और न्यायमूर्ति एजी मसीह की पीठ ने यह कहते हुए याचिका पर विचार करने से मना कर दिया कि यह मामला पहले से ही इलाहाबाद उच्च न्यायालय के समक्ष लंबित हैं।
पीठ ने हालांकि उच्च न्यायालय को इस मामले का निपटारा शीघ्र करने को कहा। पीठ के समक्ष वरिष्ठ अधिवक्ता कपिल सिब्बल ने याचिकाकर्ता का पक्ष रखते हुए उच्च न्यायालय को इस मामले पर शीघ्र विचार करने के लिए जरूरी निर्देश देने की गुहार लगाई थी। शीर्ष अदालत के इस याचिका पर सुनवाई से इनकार के बाद उन्होंने यह गुहार लगाई थी। उन्होंने अदालत के समक्ष कहा कि उत्तर प्रदेश सरकार ने 16 जून के एक निर्णय और उसके बाद 24 जून को 105 स्कूलों को बंद करने का आदेश के दिया था।
सरकार ने कथित तौर पर यह निर्णय संबंधित स्कूलों में विद्यार्थियों की नगण्य से लेकर बहुत कम होने के बाद लिया था। ऐसे स्कूलों को अन्य निकटवर्ती स्कूलों के साथ जोड़ने का फैसला किया गया था। याचिका में सरकार के इस फैसले को मनमाना, असंवैधानिक और कानूनी रूप से अनुचित कार्रवाई का आरोप लगाया था।
इसमें कहा गया था कि सरकार के इस आदेश से राज्य भर के असंख्य बच्चों को शिक्षा हासिल करने पर प्रतिकूल प्रभाव पड़ रहा है। याचिका में कहा गया था कि सरकार का यह निर्णय संविधान के अनुच्छेद 21ए और बच्चों के निःशुल्क एवं अनिवार्य शिक्षा अधिकार अधिनियम, 2009 (आरटीई अधिनियम) के तहत बच्चों के संवैधानिक और वैधानिक अधिकारों का उल्लंघन करता है।
