सनातन धर्म को मिटा दो’ वाले बयान पर SC ने तमिलनाडु के मंत्री उदयनिधि स्टालिन को लगाई फटकार
सुप्रीम कोर्ट ने सोमवार को तमिलनाडु के मंत्री उदयनिधि स्टालिन को उनकी “सनातन धर्म को मिटाओ” टिप्पणी पर फटकार लगाई और कहा कि उन्होंने भाषण और अभिव्यक्ति की स्वतंत्रता के अपने अधिकार का दुरुपयोग किया है, और आगे पूछा कि उन्होंने अपनी याचिका के साथ अदालत का रुख क्यों किया है। उनके खिलाफ दर्ज एफआईआर को एक साथ जोड़ा जा रहा है।
न्यायमूर्ति संजीव खन्ना और न्यायमूर्ति दीपांकर दत्ता की पीठ ने स्टालिन से कहा कि उन्हें अपनी टिप्पणियों के संभावित परिणामों के प्रति सचेत रहना चाहिए था और अपने बयान देते समय सावधान रहना चाहिए था। आप अनुच्छेद 19(1)(ए) (संविधान के बोलने और अभिव्यक्ति की स्वतंत्रता का अधिकार) के तहत अपने अधिकार का दुरुपयोग करते हैं। आप अनुच्छेद 25 (विवेक की स्वतंत्रता, धर्म को मानने, अभ्यास करने और प्रचार करने की स्वतंत्रता) के तहत अपने अधिकार का दुरुपयोग करते हैं। . अब आप अनुच्छेद 32 के तहत अपने अधिकार का प्रयोग कर रहे हैं (सीधे सुप्रीम कोर्ट में याचिका दायर करने के लिए)? क्या आप नहीं जानते कि आपने जो कहा उसके परिणाम क्या होंगे? आप आम आदमी नहीं हैं। आप एक मंत्री हैं। आपको परिणाम पता होना चाहिए, ” पीठ ने कहा और मामले को 15 मार्च तक के लिए स्थगित कर दिया। तमिलनाडु सरकार में मंत्री उदयनिधि स्टालिन एक प्रसिद्ध फिल्म अभिनेता हैं, जो मुख्यमंत्री एमके स्टालिन के बेटे भी हैं।
सितंबर 2023 में एक सम्मेलन को संबोधित करते हुए, उदयनिधि स्टालिन ने कहा था कि सनातन धर्म सामाजिक न्याय और समानता के खिलाफ है और इसे “उन्मूलन” किया जाना चाहिए। उन्होंने सनातन धर्म की तुलना कोविड, मलेरिया और डेंगू से की थी और कहा था कि इसे नष्ट कर देना चाहिए। स्टालिन की ओर से पेश वरिष्ठ वकील अभिषेक सिंघवी ने कहा कि वह अपने मुवक्किल की टिप्पणियों को उचित नहीं ठहरा रहे हैं, बल्कि केवल छह राज्यों में उनके खिलाफ दर्ज एफआईआर को समेकित करने की मांग कर रहे हैं।
